The Corps Marshal of the Federal Road Safety Corps (FRSC), Dauda Biu, has announced the Corps’ intention to file an appeal against a recent court ruling that limits its operations solely to Federal Highways.
The statement was made public by the Corps Public Education Officer, Assistant Corps Marshal Bisi Kareem, in Abuja on Wednesday.
The Court of Appeal in Asaba, Delta, handed down the ruling in Appeal No. CA/AS/276/2019, which was filed against the FRSC by lawyer Darlington Ugo-Ehikim.
The appellate court, on Monday, upheld the judgment of the Federal High Court, confirming the FRSC’s restriction to Federal roads. The appeal filed by the FRSC to challenge Justice E. Nwite’s judgment of the Federal High Court, Warri, was subsequently dismissed.
The initial High Court judgment, delivered on January 25, 2019, ruled in favor of the plaintiff, Darlington Ugo-Ehikim, who is a member of the Nigeria Bar Association, Warri branch.
The court granted all the reliefs sought by Ugo-Ehikim, including a declaration that the FRSC has no authority to operate or carry out any activity on State and Local Government roads.
The trial court also issued restraining orders against the Commission, prohibiting its operations on roads other than federal highways and awarded N10 million in costs against the FRSC.
Biu noted that, “we are aware of the judgement of the Court of Appeal Asaba Judicial Division from the briefing received from our Legal Representatives.
“However, as at the moment, we are yet to obtain a Certified True Copy of the judgement.
“As soon as we obtain same, we would take time to look at the judgement and make an informed decision on it. Until then, we urge the public to remain calm.”
