The Court of Appeal, sitting in Abuja, has overturned the previous judgment issued on July 24 by the National and State House of Assembly Election Tribunal.Â
The prior ruling had declared Ndudi Elumelu of the Peoples Democratic Party (PDP) as the victor in the Aniocha/Oshimili Federal Constituency election in Delta State.
However, the recent decision, rendered in Asaba, Delta State, upholds Mr. Ngozi Okolie of the Labour Party as the duly elected representative.
The Court criticized the tribunal for invalidating Okolie’s election and subsequently dismissed the petition filed by Elumelu, which had led to the invalidated judgment.
The Court supported the argument put forth by the Labour Party’s counsel, Mahmud Magaji, asserting that Okolie had been rightfully nominated and sponsored by his party and had resigned from his role as a Senior Special Assistant to the Delta State Government in accordance with constitutional requirements.
