An High Court in Abeokuta has nullified the suspension of former Deputy Speaker of the State House of Assembly, Dare Kadiri, on the grounds that it was unconstitutional.
Justice O. A. Onafowokan, who presided over the case, ruled that the suspension was an abuse of power and office by the Speaker, Olakunle Oluomo, the House of Assembly, and the Clerk of the House. The court also ordered that Kadiri, who represents Ijebu North II State Constituency, should be paid all his emoluments immediately by the state House of Assembly.
In September 2022, Kadiri and another lawmaker, Solomon Osho, were suspended by the House over allegations of breaching the rights and privileges of the state legislature. While Osho was later pardoned and recalled, Kadiri challenged his suspension in court.
During the case, the Speaker claimed that the suspension was in line with the provisions of sections 14 and 15 of the Legislative Houses (Powers and Privileges) Act, 2017 and that the appropriate number of colleague lawmakers had signed the document. However, the court ruled that the suspension was unconstitutional and an abuse of power and office.
