The Labour Party, along with their candidate Peter Obi, have formally filed a petition to overturn the declaration of Bola Tinubu as the winner of the presidential election held on February 25.
The petition, marked as CA/PEPC/03/2023, lists the Independent National Electoral Commission (INEC), Tinubu, his running mate Senator Shettima, and the All Progressives Congress (APC) as the first to fourth respondents.
The petitioners are asking the tribunal to declare that Tinubu was not elected by the majority of lawful votes cast and to order INEC to issue a new Certificate of Return to Obi. They are claiming that Tinubu was not qualified to run during the election and that there were corrupt practices and non-compliance with the Electoral Act, 2022 that made the election invalid.
The Action Alliance (AA) and the Allied Peoples Movement (APM) have also submitted separate petitions to challenge the election results. The AA’s petition, marked as CA/PEPC/01/2023, and the APM’s petition, marked as CA/PEPC/04/2023, were also submitted to the Secretariat on Monday evening. Atiku Abubakar, the candidate of the Peoples Democratic Party, has until midnight to file his petition before the deadline expires.
